“Scope of Use” means the authorized use of the Software as ordered, which may include: (a) number and type of authorized users, (b) number of licenses, copies or instances, or (c) entity, department, business unit, website, use or other restriction or insolvent unit. Customer understands that the Licensed Software may contain encryption technologies and other software that may require an export license from the U.S. Department of State and that exporting or re-exporting the Licensed Software to certain companies (e.g. B a foreign government and its subdivisions) and some countries are prohibited. Customer acknowledges that it will comply with all applicable export and import control laws and regulations of the United States and the foreign jurisdiction in which the Licensed Software is used and, in particular, Customer will not export or export the Licensed Software without all required licenses from the United States and the foreign government. Customer will defend, indemnify and hold Docker and its suppliers and licensors harmless from any violation of such laws or regulations by Customer or any of its representatives, senior officers, directors or employees. “License Term” means the authorized license term for the Software, as set forth in an order. 13.4. Consequences of Termination. Upon expiration or termination of this Agreement, your license to the Software (even if the term of the license is indicated as “unlimited” or if your order does not specify an expiration date) and you must stop and remove in your possession the use and deletion (or at our request) of all software and confidential information or other Atlassian materials in your possession (or return them at our request), including on third-party systems operated on your behalf.
You will confirm this deletion at our request. If you terminate this agreement in accordance with clause 13.2 (termination for a material reason), Atlassian will reimburse you for all prepaid software fees covering the remainder of the current license term after the effective date of termination. If atlassian terminates this agreement in accordance with clause 13.2 (termination for a material reason), you pay all outstanding fees covering the remainder of the license term in effect after the effective date of termination. In no event shall termination relieve you of the obligation to pay fees to Atlassian for the period prior to the effective date of termination. Unless this Agreement establishes an exclusive remedy, the exercise of a remedy by either Party, including denunciation, shall be without prejudice to other remedies lawfully or otherwise applicable to it under this Agreement. 7.4.
